Terms and Conditions
These terms explain how Avanni Kitchens provides design, supply and installation services to customers buying for their own home. Your written quotation, agreed specification and order confirmation set out the details of your project.
Nothing in these terms limits your statutory consumer rights.
1 Who we are
Avanni Kitchens Ltd trades as Avanni Kitchens.
Company number: 13973918
Registered office: 21 Sterry Road, Gowerton, Swansea, SA4 3BS
Email: sian@avannikitchens.uk
Telephone: 07507 610178
VAT number: [insert if registered, otherwise remove this line]
In these terms, “we”, “us” and “our” mean Avanni Kitchens Ltd, and “you” means the customer.
2 What we provide
Depending on your agreed quotation, we may provide:
-
Kitchen, bedroom and other fitted furniture design.
-
Furniture, worktops, appliances and accessories.
-
Delivery, installation and agreed project coordination.
-
Additional renovation work expressly included in your contract.
Our quotation will make clear what is included, what is excluded and who is responsible for each part of the work. Structural work, plumbing, electrics, decorating, flooring, waste removal and other trades are included only where expressly agreed.
If a fitter or renovation contractor will contract with you separately, we will identify them and explain that arrangement before you commit.
3 Quotations and orders
A quotation is valid for the period stated on it. If no validity period is stated, please ask us to confirm before accepting.
We will provide these terms and the project details before you place your order. A contract is formed when we confirm in writing that we have accepted your order. A consultation, enquiry or request for a quotation does not itself create a purchase contract.
Our written confirmation will record the agreed products, services, price, payment schedule and delivery arrangements. Any project-specific changes to these terms must be clearly agreed with you and cannot remove your statutory rights.
If we cannot accept your order, we will explain why and refund any payment taken for it.
4 Designs and measurements
We will prepare the design using the requirements and information discussed with you. Please review the proposed layout, products, finishes and specification and tell us about any changes before approving the order.
We remain responsible for our own design and surveying work. Your approval does not remove that responsibility or your consumer rights.
Where you or your own tradespeople supply measurements or specifications, please check their accuracy and tell us about any later changes. We are not responsible for errors caused solely by inaccurate information supplied to us, but this does not excuse mistakes we should reasonably have identified.
Computer-generated images are a guide to the proposed appearance. Screen colours, lighting and perspective can differ from the finished room. Products must still match the agreed description and any relevant sample or model.
5 Prices and payments
Your quotation will state the total price, including VAT where applicable, and any delivery, installation or other charges.
Deposit amounts, staged payments and due dates will be agreed in writing before you place your order. Payments must be made using an agreed method.
We will not increase an agreed price simply because our supplier costs have risen. If you request changes or additional work is needed, we will explain the cost and obtain your agreement before proceeding.
If a payment is overdue, we will contact you and allow a reasonable opportunity to resolve the issue before suspending affected work. This does not remove any legal right you have to withhold a disputed payment.
Deposits and advance payments are subject to the cancellation and refund provisions below. Paying a deposit does not automatically make it non-refundable.
6 Changes to your order
Please contact us as soon as possible if you want to change an approved design or order.
Changes may affect cost or timing and may not be possible once manufacturing has begun. We will explain the available options and obtain your agreement to any revised specification, price or timetable.
We will not substitute a materially different product or make a significant design change without your agreement.
7 Delivery and timing
We will agree a delivery date or period for your order. Made-to-order products commonly have an estimated lead time of two to eight weeks, depending on the range, but the timeframe for your order will be confirmed separately.
If no different delivery period has been agreed, goods must be delivered without undue delay and within the statutory 30-day period.
We will tell you promptly about any delay and discuss a revised plan. Estimates do not remove your legal rights if delivery or work is unreasonably delayed, or if an essential agreed deadline is missed.
Goods remain our responsibility until you, or someone you nominate, takes physical possession. Once received, please store them safely and follow any storage instructions. We remain responsible for damage caused by us and for supplying goods that meet the contract.
Please check deliveries as soon as reasonably possible and tell us about missing items or visible damage. Signing a delivery note does not waive your consumer rights, and a failure to report damage immediately does not automatically remove them.
8 Installation and site preparation
Where installation forms part of our contract, we will carry it out with reasonable care and skill. We remain responsible for subcontractors we appoint to fulfil that contract.
Before work begins, we will agree the access arrangements and any preparation you need to complete. Please provide safe access and tell us about known hazards or restrictions affecting the work.
Responsibilities for permissions, building approvals and specialist work will be recorded in the quotation. The agreed work must comply with applicable legal requirements.
If we find an unexpected problem, such as unsafe wiring, damaged pipework or an unsuitable wall, we will explain it and discuss the necessary work, cost and timing. We will not charge for additional work without your agreement.
Any charge arising from a failure to provide agreed access or preparation must be reasonable, explained and based on the resulting loss or additional work.
9 Using your own fitter
You may choose a supply-only service or appoint your own fitter or builder.
Where you contract directly with an independent tradesperson, they are responsible for the work you have commissioned from them. A recommendation does not by itself make their work part of our contract.
We remain responsible for the goods and services we supply, including our designs, agreed advice and any installation included in our own contract.
Please share the relevant plans and product instructions with your fitter and raise any compatibility concerns before installation.
10 Cancellation and returns
Statutory cooling-off rights
If your contract qualifies as a distance or off-premises contract, for example certain orders agreed remotely or at your home, a statutory cancellation right may apply unless a legal exception covers the contract.
Where that right applies, you can cancel without giving a reason by sending us a clear statement before the cancellation period ends.
-
For a service-only contract, the period normally ends 14 days after the day the contract is made.
-
For a goods contract, including a qualifying contract for goods and installation together, it normally ends 14 days after the day you or your nominee receives the goods.
-
Where one order contains goods delivered separately, the period normally runs from receipt of the last item or delivery.
You can use the cancellation form at the end of this page, but you do not have to. Emailing sian@avannikitchens.uk or writing to our registered office is sufficient. Any other clear notification is also valid.
There is generally no automatic statutory cooling-off right for an ordinary showroom purchase simply because you change your mind.
Made-to-measure and personalised goods
The statutory change-of-mind cancellation right does not normally apply to goods genuinely made to your specifications or clearly personalised.
A product is not automatically exempt merely because we order it from a supplier or you choose options from a standard range. We will identify any goods covered by the exception before you agree the contract.
Where an order combines bespoke goods, standard products and services, we will explain the applicable cancellation position before you commit. An exception for bespoke goods does not automatically remove rights under a separate service contract or separate standard-goods contract.
This exception does not affect your rights if goods are faulty, incorrectly supplied, not as described or otherwise fail to meet the contract.
Starting services during a cancellation period
Where a statutory cooling-off right applies, we will start services during that period only if you expressly request it.
If you then cancel, you may have to pay a proportionate amount for services actually provided, but only where the legal requirements for the request and advance information have been met.
For a service-only contract, you lose the cancellation right once the service has been fully performed only if you expressly requested early performance and acknowledged that consequence in advance. Completing an installation service does not by itself remove any remaining cancellation right over returnable goods in a qualifying goods contract.
Returning goods and refunds
For a valid statutory change-of-mind cancellation, goods must normally be returned within 14 days after you notify us.
You pay the direct return cost only if we told you that before the contract was made. For bulky items that cannot normally be posted, we must also have provided the required return-cost information. Otherwise, we bear those costs.
We will refund payments within the statutory timeframe, including standard outbound delivery charges where applicable. We normally refund within 14 days of being told about the cancellation, but may lawfully wait for returned goods or evidence of return where the law permits. Refunds use your original payment method unless you agree otherwise, without a refund fee.
We may make a lawful deduction for loss of value caused by handling beyond what is reasonably needed to inspect the goods. We do not impose a restocking or cancellation fee when you exercise a statutory cooling-off right.
Cancellation outside a statutory right
If you ask to cancel when no statutory cancellation right applies, please contact us promptly so we can discuss the position and whether the order can be stopped.
Where we agree cancellation, any charge or deduction must be fair and reflect losses directly caused by it. We will take reasonable steps to reduce those losses, account for costs saved and avoid charging twice for the same loss.
We will explain any charge and refund payments exceeding the amount lawfully due. These provisions do not apply to restrict rights arising from our breach of contract.
11 Faults and your consumer rights
Goods must be of satisfactory quality, fit for the agreed purpose and as described. Services must be provided with reasonable care and skill and meet the agreed terms.
If something is wrong, contact us with your order details and a description of the problem. Photographs may help, but are not a condition of your statutory rights.
Depending on the circumstances, your rights may include rejecting faulty goods, a repair or replacement, a price reduction, a refund, repeat performance of services or compensation.
We are responsible for resolving valid complaints about goods we supplied. You do not have to pursue the manufacturer instead.
We may arrange a reasonable inspection to understand the problem. We will not use inspection arrangements to delay a remedy you are legally entitled to.
12 Warranties and product care
Any manufacturer warranty or additional workmanship guarantee will be explained in the documents provided for your order. It is additional to your statutory rights and does not replace them.
We do not offer a general lifetime guarantee.
Please follow the relevant care, cleaning and maintenance instructions. Normal wear, misuse or accidental damage may fall outside an additional warranty, but this does not remove rights relating to an existing fault or our failure to meet the contract.
Natural materials can show reasonable variation in grain, texture and tone. This does not excuse a defect or a failure to match an agreed description or relevant sample.
13 Responsibility for loss or damage
We are responsible for foreseeable loss or damage caused by our breach of contract or negligence.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability or consumer right that cannot lawfully be excluded or limited.
If an event outside our reasonable control affects the project, we will notify you and take reasonable steps to reduce its impact. Your legal rights to cancel, receive a refund or claim an appropriate remedy remain unaffected.
14 Designs and website content
Copyright in our original designs, drawings and website content belongs to us or the relevant rights holder.
You may use the plans we provide for your agreed home project, including sharing them with your chosen fitter. Commercial reuse or reproduction requires the rights holder's permission.
Please use our website lawfully. Do not attempt to disrupt it, gain unauthorised access or misuse its enquiry forms.
15 Personal information
We use personal information to handle enquiries, prepare designs and quotations, fulfil orders and manage customer relationships. Please read our Privacy Policy and Cookie Policy for details.
16 Complaints
Please contact sian@avannikitchens.uk or write to our registered office with your order reference and the details of your complaint.
We will investigate, keep you informed and explain the proposed resolution. If we cannot resolve the complaint, we will provide information about relevant alternative dispute resolution options where required by law, including whether we are required or willing to use the scheme.
You retain your right to seek advice and bring legal proceedings.
17 Applicable law and changes
These terms are governed by the law of England and Wales. This does not remove any mandatory consumer protections that apply where you live or any right to bring proceedings in your home jurisdiction.
If a term is found unenforceable, the remaining terms continue to apply so far as legally possible.
We may update these terms for future orders. Changes do not alter an existing contract unless you agree or the law requires them.
Optional cancellation form
Complete and send this form only if you wish to cancel a contract for which you have a cancellation right.
